2. Intellectual Property Rights

Unless explicitly specified in a written bilateral client agreement, all content, features, and functionality on our website and applications (including but not limited to source code, algorithms, visual designs, trademarks, text, graphics, logos, icons, and software) are the exclusive property of JivantaVyom and are protected by applicable intellectual property laws, trademark protections, and copyright regulations.

You may not copy, reproduce, distribute, reverse-engineer, decompile, modify, or create derivative works from our software without prior express written authorization.

3. Mobile Application License & Permitted Use

Subject to your compliance with these Terms, JivantaVyom grants you a revocable, non-exclusive, non-transferable, limited license to download, install, and execute our applications on mobile devices strictly for your personal, non-commercial use (or authorized commercial internal use where explicitly designated).

You agree not to:

• Circumvent, disable, or tamper with security or digital rights management features of our applications.
• Use automated systems, scrapers, bots, or exploits to extract data or overload infrastructure.
• Engage in illegal, fraudulent, harassing, defamatory, or harmful conduct through our platforms.
• Distribute modified, cracked, or unauthorized APK/bundle versions of our Google Play Store applications.

4. Third-Party Marketplaces & Google Play Terms

If you download our applications via the Google Play Store, you acknowledge and agree that your use is additionally governed by Google’s applicable terms, including the Google Play Terms of Service. In the event of a conflict between these Terms and the Google Play Terms of Service with respect to app distribution, Google's policies shall control.

5. Disclaimers & "As-Is" Provision

Our website, services, and applications are provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express, statutory, or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, uptime, accuracy, or non-infringement.

We do not warrant that our services will always be uninterrupted, error-free, completely secure, or that defects will be corrected instantaneously.

6. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall JivantaVyom, its founders, directors, employees, or partners be liable for any indirect, punitive, incidental, special, consequential, or exemplary damages, including without limitation damages for loss of profits, goodwill, data, or business interruption, arising out of or in connection with the use or inability to use our website or mobile apps.

7. Indemnification

You agree to defend, indemnify, and hold harmless JivantaVyom and its affiliates from and against any claims, liabilities, damages, judgments, losses, costs, or expenses (including reasonable legal fees) resulting from your violation of these Terms or misuse of our software.

8. Termination

We reserve the right to suspend or terminate your access to our applications and services at our sole discretion, without notice, for conduct that we believe violates these Terms, violates applicable law, or is harmful to other users or our business interests.

9. Governing Law & Dispute Resolution

These Terms shall be governed by, construed, and enforced in accordance with the laws of India, without regard to its conflict of law principles. Any dispute or claim arising out of or relating to these Terms or our services shall be subject to the exclusive jurisdiction of the competent courts located in Surat, Gujarat, India.
